Mindful Terms of Service

1. Agreement to these terms

Nexus Kairos LLC (“we,” “us,” or “our”) makes Mindful, an iOS app (the “App”). By downloading, installing or using the App you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the App. Our Privacy Policy explains what Mindful collects and forms part of these Terms.

2. What Mindful does

Mindful shields the apps you choose on your own iPhone through Apple’s Screen Time framework. You set up blocklists, schedule windows, focus sessions and app limits. When you open a shielded app, Mindful shows a shield and asks you to state your intent. The App also shows daily statistics, a clarity score and streaks.

Mindful is a self-control tool. It is not a parental-control app and is not designed to monitor another person's device. It is not medical, psychological or professional advice.

3. Who may use Mindful

You must be at least 13 years old. If you are under 18, you confirm that a parent or guardian has agreed to your use of the App. You may install Mindful only on a device that you own or are authorised to use.

4. Screen Time authorization and the shield

For shielding to work you grant Mindful the iOS Screen Time (Family Controls) authorization. Mindful shields only the apps, categories and websites you pick. iOS itself enforces the shield, so Mindful cannot bypass it or override what iOS decides.

Deleting the App, or revoking the Screen Time authorization in iOS Settings, removes every shield at once. A shield works only on the device that created it. Mindful is not responsible for a shield that iOS interrupts because of an iOS update, a Screen Time passcode change or an Apple ID change.

5. Your account

Mindful asks you to sign in once, at the end of setup, with Sign in with Apple or Google. The account carries your Pro purchase to a new phone and holds a backup of the shape of your setup. Which apps you block is never stored in the account. Shields, schedules, sessions, limits and statistics all run on your phone.

• One person, one account. You may not transfer your account to someone else.
• You are responsible for keeping your Apple or Google credentials secure.
• A restored backup brings back each blocklist with its name and app count, but no apps. You pick the apps again.
• You can sign out or delete the account in Settings. Deleting the account cannot be undone and does not cancel a subscription.
• We may suspend or close an account that breaches these Terms.

6. Strict mode and the emergency pass

Strict mode is a Pro feature and is strict on purpose. While a scheduled window is active: no shielded app can be unlocked, and Strict mode cannot be switched off in Settings. The one exit is the emergency pass: once per day, a 60-second countdown, a typed confirmation, then a 5-minute unlock. Every pass is recorded in your statistics.

By turning Strict mode on you accept that it may keep you out of an app you need until the window ends. Deleting the App removes every shield. We are not liable for time, opportunities or consequences that follow from a Strict window.

7. Free, Pro and subscriptions

The free tier of Mindful gives you one schedule window, one blocklist, a limited number of apps, Soft mode and the whole statistics tab. Mindful Pro unlocks unlimited schedules, blocklists and apps, categories and web domains, Strict mode, app limits and custom proverb collections.

• Plans. A monthly subscription, an annual subscription with a 7-day free trial, and a one-time lifetime purchase. The price is shown in the App and in the App Store before you buy.
• Payment. Every purchase goes through Apple In-App Purchase and is charged to your Apple ID by Apple. We never see your card details.
• Renewal. Monthly and annual subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. If you do not cancel before the free trial ends, the annual price is charged. Lifetime does not renew.
• Cancelling. Cancel in iPhone Settings, then Apple ID, then Subscriptions. Deleting the App does not cancel a subscription. After you cancel, Pro stays active until the end of the period you have paid for.
• Refunds. Apple decides refunds under its standard policy. Request one at reportaproblem.apple.com.
• Price changes. We may change prices. Apple notifies you before a change affects your subscription and asks for your consent where required.
• Restoring. Pro is tied to the Apple ID that bought it and, when you are signed in, to your Mindful account. On a new phone, sign in or tap “Restore purchases”.

8. Acceptable use

You agree not to:

• Install or use the App on another person’s device without their knowledge and consent.
• Reverse engineer, decompile, copy, modify or create derivative works of the App.
• Circumvent Pro entitlements, purchase checks or tier limits.
• Attack or overload our services or those of our providers, such as Firebase and RevenueCat.
• Use the App for any unlawful purpose.

9. Intellectual property and licence

The App, its design, code, branding and proverb collections belong to Nexus Kairos LLC. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your own device for personal, non-commercial purposes. This licence is at least as protective as Apple’s standard App Store EULA.

10. No warranty

The App is supplied “as is” and “as available”. We do not promise:

• that your screen time will fall
• that your productivity will rise
• that lost time will come back
• that shielding will be uninterrupted or error-free

Shielding depends on iOS and Apple’s Screen Time framework, which we do not control. To the extent the law allows, we disclaim all express and implied warranties.

11. Limitation of liability

To the extent the law allows, Nexus Kairos LLC is not liable for any indirect, incidental, special or consequential damage, lost profit or lost data arising from your use of the App. Where liability does arise, our total liability is capped at what you paid Mindful in the 12 months before the claim. Some jurisdictions do not allow such limits; there, our liability is limited to the smallest amount the law permits.

12. Termination

You may stop at any time by deleting the App and deleting your account in Settings. We may end your access to the App if you breach these Terms. The sections on intellectual property, warranty, limitation of liability and governing law survive termination.

13. Changes to these terms

We may change these Terms. We will post any change on this page and move the date at the top. If a change is material, we will say so in the App. Continuing to use the App after a change means you accept the new Terms.

14. Governing law

These Terms are governed by the law of Mongolia, and disputes fall to the courts of Mongolia. You keep any consumer rights that the law of your country of residence gives you and does not allow you to waive.

15. Apple

These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its support. If the App fails to conform to these Terms, you may notify Apple and Apple may refund the purchase price. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you once you accept them.
